Our solution leverages dynamic creator discovery powered by our AI agent, Spencer, to conduct market research and match your campaign needs with the ideal creators—without relying on a static network database.

4. Pricing, Payment & Refunds
Spencer AI operates on a credit-based system rather than a traditional subscription model. To get started, clients must first schedule an onboarding call with our team. During this call, we assess your campaign requirements and determine the appropriate credit allocation on a case-by-case basis.

  • Onboarding Call:
    Prior to purchasing credits, every client will book an onboarding call to discuss their campaign objectives and receive a tailored pricing proposal.

  • Credit System:
    Instead of a recurring subscription, you will fund your campaign by loading your account with credits. For example, if you plan a $5,000 marketing campaign, you will deposit $5,000, and we will convert this into credits that can be used to execute and manage your campaign.

  • Payment Terms:
    Payments are made upfront as part of the credit purchase. Credits will be deducted from your account as campaign services are rendered.

  • Refunds:
    Refunds are evaluated on a case-by-case basis. Any requests for refunds will be considered based on the specific circumstances of your campaign and the services provided.


5. Data Handling

    Spencer AI collects engagement metrics for the campaigns run through our platform. We do not collect any additional data or personally identifiable information beyond what is required for account logins.

  • Storage & Protection:
    We securely store your account credentials, such as your email and password, using industry-standard encryption and security protocols. Our measures are designed to protect your login data from unauthorized access.

  • Third-Party Sharing:
    We do not share any of your data with third parties.


6. Usage Limitations

  • General Use:
    Spencer AI is designed exclusively for the management of legitimate influencer marketing campaigns. Users agree to use the platform only for its intended purpose.

  • Prohibited Activities:
    Any misuse of the platform is strictly prohibited. This includes, but is not limited to:

    • Engaging in fraudulent activities or manipulations of campaign metrics.

    • Using the platform for any illegal activities or actions that infringe upon the rights of others.

    • Unauthorized access or interference with the functionality of Spencer AI or any related systems.

By using Spencer AI, you agree to abide by these limitations and ensure that your campaigns are conducted in a lawful and ethical manner.


7. Maintenance & Updates

  • Scheduled Maintenance:
    Spencer AI may require periodic maintenance to ensure optimal performance. We will strive to notify users in advance of any scheduled maintenance that might temporarily affect access to the platform.

  • Updates:
    We continuously work to enhance Spencer AI by rolling out updates that include new features, performance improvements, and bug fixes. While we aim to minimize disruptions, users might experience brief periods of downtime during these updates, and occasional adjustments to integration settings may be necessary.


8. Liability & Warranty

  • Limited Warranty:
    Spencer AI is provided on an "as is" basis. While we strive to maintain a reliable and high-performing service, we do not guarantee that the platform will be error-free, uninterrupted, or secure from unauthorized access. Your use of the service is at your own risk.

  • Liability:
    To the fullest extent permitted by law, Spencer AI, its affiliates, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform. Users are advised to thoroughly test the service and understand its current capabilities and limitations.


9. Termination

  • User-Initiated Termination:
    If you wish to terminate your account, you must first consult with us. All termination requests will be handled on a case-by-case basis. Please note that any credits remaining in your account are non-refundable unless Spencer AI explicitly states otherwise, and we reserve the right to review such requests individually.

  • Termination by Spencer AI:
    Spencer AI will generally consult with clients and provide notice prior to terminating any account. However, if we observe any harmful activities or illegal behavior, we reserve the right to terminate your account immediately without prior consultation.


10. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the use of Spencer AI shall be subject to the exclusive jurisdiction of the courts located in San Francisco, California.

Spencer AI reserves the right to update these Terms of Use periodically. Users will be notified of any significant changes, and it remains your responsibility to review the Terms regularly to ensure continued compliance.
